An act to amend Section 51225.3 of the Education Code, relating to pupil instruction.

SB 1123, as introduced, Leyva. Pupil instruction: high school graduation requirements.

Existing law requires each pupil completing grade 12 to satisfy certain requirements as a condition of receiving a diploma of graduation from high school. These requirements include the completion of designated coursework in grades 9 to 12, inclusive. The coursework requirements include, among others, the completion of one course in visual or performing arts, foreign language, or, commencing with the 2012-13 school year and continuing until the end of the 2016-17 school year on July 1, 2017, or until the occurrence of a specified event relating to career technical education requirements of the University of California and the California State University, whichever occurs earlier, career technical education, as specified.

This bill would instead require that the coursework requirements include, among others, the completion of one course in visual or performing arts, foreign language, or, commencing with the 2012-13 school year and continuing until the end of the 2021-22 school year on July 1, 2022, or until the occurrence of a specified event relating to career technical education requirements of the University of California and the California State University, whichever occurs earlier, career technical education, as specified.

The people of the State of California do enact as follows:

SECTION 1.  

Section 51225.3 of the Education Code, as
2amended by Section 1 of Chapter 888 of the Statutes of 2014, is
3amended to read:

51225.3.  

(a) A pupil shall complete all of the following while
5in grades 9 to 12, inclusive, in order to receive a diploma of
6graduation from high school:

7(1) At least the following numbers of courses in the subjects
8specified, each course having a duration of one year, unless
9otherwise specified:

10(A) Three courses in English.

11(B) Two courses in mathematics. If the governing board of a
12school district requires more than two courses in mathematics for
13graduation, the governing board of the school district may award
14a pupil up to one mathematics course credit pursuant to Section
1551225.35.

16(C) Two courses in science, including biological and physical
17sciences.

18(D) Three courses in social studies, including United States
19history and geography; world history, culture, and geography; a
20one-semester course in American government and civics; and a
21one-semester course in economics.

22(E) One course in visual or performing arts, foreign language,
23or, commencing with the 2012-13 school year, career technical
24education.

25(i) For purposes of satisfying the requirement specified in this
26subparagraph, a course in American Sign Language shall be
27deemed a course in foreign language.

28(ii) For purposes of this subparagraph, “a course in career
29technical education” means a course in a district-operated career
30technical education program that is aligned to the career technical
31model curriculum standards and framework adopted by the state
32board, including courses through a regional occupational center
33or program operated by a county superintendent of schools or
34pursuant to a joint powers agreement.

35(iii) This subparagraph does not require a school or school
36district that currently does not offer career technical education
37courses to start new career technical education programs for
38purposes of this section.

P3    1(iv) If a school district or county office of education elects to
2allow a career technical education course to satisfy the requirement
3imposed by this subparagraph, the governing board of the school
4district or county office of education, before offering that
5alternative to pupils, shall notify parents, teachers, pupils, and the
6public at a regularly scheduled meeting of the governing board of
7all of the following:

8(I) The intent to offer career technical education courses to fulfill
9the graduation requirement specified in this subparagraph.

10(II) The impact that offering career technical education courses,
11pursuant to this subparagraph, will have on the availability of
12courses that meet the eligibility requirements for admission to the
13California State University and the University of California, and
14whether the career technical education courses to be offered
15pursuant to this subparagraph are approved to satisfy those
16eligibility requirements. If a school district elects to allow a career
17technical education course to satisfy the requirement imposed by
18this subparagraph, the school district shall comply with subdivision
19(m) of Section 48980.

20(III) The distinction, if any, between the high school graduation
21requirements of the school district or county office of education,
22and the eligibility requirements for admission to the California
23State University and the University of California.

24(F) Two courses in physical education, unless the pupil has been
25exempted pursuant to the provisions of this code.

26(2) Other coursework requirements adopted by the governing
27board of the school district.

28(b) The governing board, with the active involvement of parents,
29administrators, teachers, and pupils, shall adopt alternative means
30for pupils to complete the prescribed course of study that may
31include practical demonstration of skills and competencies,
32supervised work experience or other outside school experience,
33career technical education classes offered in high schools, courses
34offered by regional occupational centers or programs,
35interdisciplinary study, independent study, and credit earned at a
36postsecondary educational institution. Requirements for graduation
37and specified alternative modes for completing the prescribed
38course of study shall be made available to pupils, parents, and the
39public.

P4    1(c) On or before July 1, 2017, the department shall submit a
2comprehensive report to the appropriate policy committees of the
3Legislature on the addition of career technical education courses
4to satisfy the requirement specified in subparagraph (E) of
5paragraph (1) of subdivision (a), including, but not limited to, the
6following information:

7(1) A comparison of the pupil enrollment in career technical
8education courses, foreign language courses, and visual and
9performing arts courses for the 2005-06 to 2011-12 school years,
10inclusive, to the pupil enrollment in career technical education
11courses, foreign language courses, and visual and performing arts
12courses for the 2012-13 to 2016-17 school years, inclusive.

13(2) The reasons, reported by school districts, that pupils give
14for choosing to enroll in a career technical education course to
15satisfy the requirement specified in subparagraph (E) of paragraph
16(1) of subdivision (a).

17(3) The type and number of career technical education courses
18that were conducted for the 2005-06 to 2011-12 school years,
19inclusive, compared to the type and number of career technical
20education courses that were conducted for the 2012-13 to 2016-17
21school years, inclusive.

22(4) The number of career technical education courses that
23satisfied the subject matter requirements for admission to the
24University of California or the California State University.

25(5) The extent to which the career technical education courses
26chosen by pupils are aligned with the California Career Technical
27Education Standards, and prepare pupils for employment, advanced
28training, and postsecondary education.

29(6) The number of career technical education courses that also
30satisfy the visual and performing arts requirement, and the number
31of career technical education courses that also satisfy the foreign
32language requirement.

33(7) Annual pupil dropout and graduation rates for the 2011-12
34to 2014-15 school years, inclusive.

35(d) For purposes of completing the report described in
36subdivision (c), the Superintendent may use existing state resources
37and federal funds. If state or federal funds are not available or
38sufficient, the Superintendent may apply for and accept grants,
39and receive donations and other financial support from public or
40private sources for purposes of this section.

P5    1(e) For purposes of completing the report described in
2subdivision (c), the Superintendent may accept support, including,
3but not limited to, financial and technical support, from high school
4reform advocates, teachers, chamber organizations, industry
5representatives, research centers, parents, and pupils.

6(f) This section shall become inoperative on the earlier of the
7following two dates:

8(1) On July 1, immediately following the first fiscal year after
9the enactment of the act that adds this paragraph in which the
10number of career technical education courses that, as determined
11by the department, satisfy the foreign language requirement for
12admission to the California State University and the University of
13 California is at least twice the number of career technical education
14courses that meet these admission requirements as of January 1,
152012. This section shall be repealed on the following January 1,
16unless a later enacted statute, that becomes operative on or before
17that date, deletes or extends the dates on which it becomes
18inoperative and is repealed. It is the intent of the Legislature that
19new career technical education courses that satisfy the foreign
20language requirement for admission to the California State
21University and the University of California focus on world
22languages aligned with career preparation, emphasizing real-world
23application and technical content in related career and technical
24education courses.

25(2) On July 1,begin delete 2017,end deletebegin insert 2022,end insert and, as of January 1,begin delete 2018,end deletebegin insert 2023,end insert is
26repealed, unless a later enacted statute, that becomes operative on
27or before January 1,begin delete 2018,end deletebegin insert 2023,end insert deletes or extends the dates on
28which it becomes inoperative and is repealed.
