An act to amend Section 13996.41 of the Government Code, relating to state government.

Existing law requires the Governor’s Office of Business and Economic Development (GO-Biz) to develop and implement an International Trade and Investment Program and authorizes the director of GO-Biz to establish international trade and investment offices, as specified.

This bill would make technical, nonsubstantive changes to these provisions.

The people of the State of California do enact as follows:

SECTION 1.  

Section 13996.41 of the Government Code is
2amended to read:

13996.41.  

(a) The Governor’s Office of Business and
4Economic Development shall develop and implement an
5International Trade and Investment Program that does all of the
6following:

7(1) Attracts employment-producing direct foreign investment
8to the state.

P2    1(2) Provides support for California businesses in accessing
2international markets, including assistance to increase California
3exports.

4(3) Engages in other international trade or foreign investment
5activities assigned by the Governor.

6(b) The Director of the Governor’s Office of Business and
7Economic Development may establish and terminate international
8trade and investment offices outside of the United States as he or
9she determines is appropriate if the requirements of Section
1013996.65 are satisfied.

11(c) This section shall not be construed to confer powers or
12impose duties upon the Governor’s Office of Business and
13Economic Development that conflict with any powers conferred
14or duties imposed upon the Department of Food and Agriculture
15with respect to the promotion of California agriculture, fish, or
16forest exports.

17(d) The Governor’s Office of Business and Economic
18Development shall develop a conflict-of-interest and gift policy
19that applies to the Governor’s Office of Business and Economic
20Development and all international trade and investment offices

22(e) Any international trade and investment office established
23by the Governor’s Office of Business and Economic Development
24may be funded in whole or in part by nonstate funds.

25(f) The Governor’s Office of Business and Economic
26Development may contract with a nonprofit entity to operate an
27international trade and investment office. The contract shall, among
28other provisions, require the nonprofit entity to provide the
29Governor’s Office of Business and Economic Development
30information sufficient to satisfy the reporting requirements in
31subdivision (c) of Section 13997 within 30 days of receipt by the
32nonprofit entity of each donation used to fund an international
33trade and investment office.
