An act to amend Section 2932 of the Vehicle Code, relating to motorcycle safety.

AB 841, as introduced, Jones. Motorcyclist safety training programs.

Existing law authorizes the Commissioner of the California Highway Patrol, through contracts with other public agencies or with private entities, to provide financial or other support to projects aimed at enhancing motorcycle operation or safety. Existing law requires all administrative costs of a premier motorcyclist safety training program to be paid for by the provider.

This bill would specify that those administrative costs would include the cost of owning and maintaining motorcycles. The bill would also make various technical, nonsubstantive changes.

The people of the State of California do enact as follows:

SECTION 1.  

Section 2932 of the Vehicle Code is amended to

5the following:

P2    1(a) Provide financial or other support to projects aimed at
2enhancing motorcycle operation and safety, including, but not
3limited to, motorcyclist safety training programs. The motorcyclist
4safety training programs shall comply with criteriabegin delete whichend deletebegin insert thatend insert the
5commissioner, in consultation with other state agencies and
6national motorcycle safety organizations, may adopt to provide
7validated motorcyclist safety training programs in the state.

8(b) Sponsor and coordinate efforts aimed at increasing motorists’
9awareness of motorcyclists.

10(c) Sponsor research into effective communication techniques
11to reach all highway users on matters of motorcyclist safety.

12(d) Establish an advisory committee of persons from other state
13and local agencies with an interest in motorcyclebegin delete safety;end deletebegin insert safety,end insert
14 persons from the motorcyclebegin delete industry;end deletebegin insert industry,end insert motorcycle safety
15begin delete organizations;end deletebegin insert organizations,end insert motorcycle enthusiastbegin delete organizations;end delete
16begin insert organizations,end insert and others with an interest in motorcycle safety, to
17assist in the establishment of a comprehensive program of
18motorcycle safety.

19(e) Adopt standards for course content, contact hours,
20curriculum, instructor training and testing, and instructional quality
21control, and setting forth a maximum amount for course fees for
22the novice rider training coursebegin insert asend insert specified in subdivisions (g)
23and (i) of Section 12804.9.

24(f) (1) Adopt standards for course content, contact hours,
25curriculum, instructor training and testing, and instructional quality
26control, for a premier motorcyclist safety training program.
27Motorcycle safety training courses offered under a premier
28motorcyclist safety training program shall meet all of the following
29requirements:

30(A) Provide a core curriculum approved for the novice rider
31training course specified in subdivision (e).

32(B) Additional course requirements established by the
33commissioner.

34(2) On and after January 1, 2008, the commissioner shall not
35impose a maximum amount for course fees for courses provided
36under the premier motorcyclist safety training program.

37(3) All administrative costs of a premier motorcyclist safety
38training programbegin insert, including the cost of owning and maintaining

shall be paid for by the provider, and none of the
2costs shall be paid for by the state.
