(1) Existing law, the California Comprehensive Sexual Health and HIV/AIDS Prevention Education Act, authorizes school districts to provide comprehensive sexual health education, consisting of age-appropriate instruction, in any of kindergarten and grades 1 to 12, inclusive, and requires school districts to ensure that all pupils in grades 7 to 12, inclusive, receive HIV/AIDS prevention education, as specified.

This bill would revise and recast these provisions to, among other things, integrate the instruction of comprehensive sexual health education and HIV prevention education. The bill would rename the California Comprehensive Sexual Health and HIV/AIDS Prevention Education Act the California Healthy Youth Act. The bill would specify additional purposes of the act. The bill would instead require school districts to ensure that all pupils in grades 7 to 12, inclusive, receive comprehensive sexual health education and HIV prevention education, as specified. By imposing additional requirements on school districts, this bill would impose a state-mandated local program.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

SEC. 2.  

Section 51930 of the Education Code is amended to

(a) This chapter shall be known, and may be cited, as
10the California Healthy Youth Act.

11(b) The purposes of this chapter are as follows:

12(1) To provide pupils with the knowledge and skills necessary
13to protect their sexual and reproductive health from HIV and other
14sexually transmitted infections and from unintended pregnancy.

15(2) To provide pupils with the knowledge and skills they need
16to develop healthy attitudes concerning adolescent growth and
17development, body image, gender, sexual orientation, relationships,
18marriage, and family.

19(3) To promote understanding of sexuality as a normal part of
20human development.

21(4) To ensure pupils receive integrated, comprehensive, accurate,
22and unbiased sexual health and HIV prevention instruction and
23provide educators with clear tools and guidance to accomplish that
24end.

25(5) To provide pupils with the knowledge and skills necessary
26to have healthy, positive, and safe relationships and behaviors.

SEC. 3.  

Section 51931 of the Education Code is amended to
28read:

51931.  

For the purposes of this chapter, the following
30definitions apply:

31(a) “Age appropriate” refers to topics, messages, and teaching
32methods suitable to particular ages or age groups of children and
33adolescents, based on developing cognitive, emotional, and
34behavioral capacity typical for the age or age group.

35(b) “Comprehensive sexual health education” means education
36regarding human development and sexuality, including education
37on pregnancy, contraception, and sexually transmitted infections.

P4    1(c) “English learner” means a pupil as described in subdivision
2(a) of Section 306.

3(d) “HIV prevention education” means instruction on the nature
4of human immunodeficiency virus (HIV) and AIDS, methods of
5transmission, strategies to reduce the risk of HIV infection, and
6social and public health issues related to HIV and AIDS.

7(e) “Instructors trained in the appropriate courses” means
8instructors with knowledge of the most recent medically accurate
9research on human sexuality, healthy relationships, pregnancy,
10and HIV and other sexually transmitted infections.

11(f) “Medically accurate” means verified or supported by research
12conducted in compliance with scientific methods and published
13in peer-reviewed journals, where appropriate, and recognized as
14accurate and objective by professional organizations and agencies
15with expertise in the relevant field, such as the federal Centers for
16Disease Control and Prevention, the American Public Health
17Association, the American Academy of Pediatrics, and the
18American College of Obstetricians and Gynecologists.

19(g) “School district” includes county boards of education, county
20superintendents of schools, the California School for the Deaf, and
21the California School for the Blind.

Section 51932 of the Education Code is amended to

SEC. 6.  

Section 51933 of the Education Code is amended to
5read:

51933.  

All comprehensive sexual health education and HIV
7prevention education pursuant to Section 51934, whether taught
8or supplemented by school district personnel or by outside
9consultants or guest speakers pursuant to Section 51936, shall
10satisfy all of the following criteria:

11(a) Instruction and materials shall be age appropriate.

12(b) All factual information presented shall be medically accurate
13and objective.

14(c) All instruction and materials shall align with and support
15the purposes of this chapter as set forth in paragraphs (1) to (5),
16inclusive, of subdivision (b) of Section 51930 and may not be in
17conflict with them.

18(d) (1) Instruction and materials shall be appropriate for use
19with pupils of all races, genders, sexual orientations, and ethnic
20and cultural backgrounds, pupils with disabilities, and English
21learners.

22(2) Instruction and materials shall be made available on an equal
23basis to a pupil who is an English learner, consistent with the
24existing curriculum and alternative options for an English learner
25pupil as otherwise provided in this code.

26(3) Instruction and materials shall be accessible to pupils with
27disabilities, including, but not limited to, the provision of a
28modified curriculum, materials and instruction in alternative
29formats, and auxiliary aids.

30(4) Instruction and materials shall not reflect or promote bias
31against any person on the basis of any category protected by
32Section 220.

33(5) Instruction and materials shall affirmatively recognize that
34people have different sexual orientations and, when discussing or
35providing examples of relationships and couples, shall be inclusive
36of same-sex relationships.

37(6) Instruction and materials shall teach pupils about gender,
38gender expression, gender identity, and explore the harm of
39negative gender stereotypes.

P6    1(e) Instruction and materials shall encourage a pupil to
2communicate with his or her parents, guardians, and other trusted
3adults about human sexuality and provide the knowledge and skills
4necessary to do so.

5(f) Instruction and materials shall teach the value of and prepare
6pupils to have and maintain committed relationships such as
7marriage.

8(g) Instruction and materials shall provide pupils with knowledge
9and skills they need to form healthy relationships that are based
10on mutual respect and affection, and are free from violence,
11coercion, and intimidation.

12(h) Instruction and materials shall provide pupils with knowledge
13and skills for making and implementing healthy decisions about
14sexuality, including negotiation and refusal skills to assist pupils
15in overcoming peer pressure and using effective decisionmaking
16skills to avoid high-risk activities.

17(i) Instruction and materials may not teach or promote religious
18doctrine.

SEC. 7.  

The heading of Article 3 (commencing with Section
2051934) of Chapter 5.6 of Part 28 of Division 4 of Title 2 of the 21Education Code is repealed.

SEC. 8.  

Section 51934 of the Education Code is amended to
23read:

51934.  

(a) Each school district shall ensure that all pupils in
25grades 7 to 12, inclusive, receive comprehensive sexual health
26education and HIV prevention education from instructors trained
27in the appropriate courses. Each pupil shall receive this instruction
28at least once in junior high or middle school and at least once in
29high school. This instruction shall include all of the following:

30(1) Information on the nature of HIV, as well as other sexually
31transmitted infections, and their effects on the human body.

32(2) Information on the manner in which HIV and other sexually
33transmitted infections are and are not transmitted, including
34information on the relative risk of infection according to specific
35 behaviors, including sexual activities and injection drug use.

36(3) Information that abstinence from sexual activity and injection
37drug use is the only certain way to prevent HIV and other sexually
38transmitted infections and abstinence from sexual intercourse is
39the only certain way to prevent unintended pregnancy. Instruction
40shall provide information about the value of delaying sexual
P7    1activity while also providing medically accurate information on
2other methods of preventing HIV and other sexually transmitted
3infections and pregnancy.

4(4) Information about the effectiveness and safety of all federal
5Food and Drug Administration (FDA) approved methods that
6prevent or reduce the risk of contracting HIV and other sexually
7transmitted infections, including use of antiretroviral medication,
8consistent with the federal Centers for Disease Control and
9Prevention.

10(5) Information about the effectiveness and safety of reducing
11the risk of HIV transmission as a result of injection drug use by
12decreasing needle use and needle sharing.

13(6) Information about the treatment of HIV and other sexually
14transmitted infections, including how antiretroviral therapy can
15dramatically prolong the lives of many people living with HIV
16and reduce the likelihood of transmitting HIV to others.

17(7) Discussion about social views on HIV and AIDS, including
18addressing unfounded stereotypes and myths regarding HIV and
19AIDS and people living with HIV. This instruction shall emphasize
20that successfully treated HIV-positive individuals have a normal
21life expectancy, all people are at some risk of contracting HIV,
22and the only way to know if one is HIV-positive is to get tested.

23(8) Information about local resources, how to access local
24resources, and pupils’ legal rights to access local resources for
25sexual and reproductive health care such as testing and medical
26care for HIV and other sexually transmitted infections and
27pregnancy prevention and care, as well as local resources for
28assistance with sexual assault and intimate partner violence.

29(9) Information about the effectiveness and safety of all
30FDA-approved contraceptive methods in preventing pregnancy,
31including, but not limited to, emergency contraception. Instruction
32on pregnancy shall include an objective discussion of all legally
33available pregnancy outcomes, including, but not limited to, all of
34the following:

35(A) Parenting, adoption, and abortion.

36(B) Information on the law on surrendering physical custody
37of a minor child 72 hours of age or younger, pursuant to Section
381255.7 of the Health and Safety Code and Section 271.5 of the
39Penal Code.

40(C) The importance of prenatal care.

P8    1(10) Information about sexual harassment, sexual assault,
2adolescent relationship abuse, intimate partner violence, and sex
3trafficking.

4(b) A school district may provide comprehensive sexual health
5education or HIV prevention education consisting of
6age-appropriate instruction earlier than grade 7 using instructors
7trained in the appropriate courses. A school district that elects to
8offer comprehensive sexual health education or HIV prevention
9education earlier than grade 7 may provide age appropriate and
10medically accurate information on any of the general topics
11contained in paragraphs (1) to (10), inclusive, of subdivision (a).

SEC. 9.  

The heading of Article 4 (commencing with Section

SEC. 10.  

Section 51935 of the Education Code is amended to

51935.  

(a) A school district shall cooperatively plan and
21conduct in-service training for all school district personnel that
22provide HIV prevention education, through regional planning,
23joint powers agreements, or contract services.

24(b) In developing and providing in-service training, a school
25district shall cooperate and collaborate with the teachers of the
26district who provide HIV prevention education and with the
27department.

28(c) In-service training shall be conducted periodically to enable
29school district personnel to learn new developments in the scientific
30understanding of HIV. In-service training shall be voluntary for
31school district personnel who have demonstrated expertise or
32received in-service training from the department or federal Centers
33for Disease Control and Prevention.

34(d) A school district may expand HIV in-service training to
35cover the topic of comprehensive sexual health education in order
36for school district personnel who provide comprehensive sexual
37health education to learn new developments in the scientific
38understanding of sexual health.

SEC. 11.  

Section 51936 of the Education Code is amended to
40read:

School districts may contract with outside consultants
2or guest speakers, including those who have developed multilingual
3curricula or curricula accessible to persons with disabilities, to
4deliver comprehensive sexual health education and HIV prevention
5education or to provide training for school district personnel. All
6outside consultants and guest speakers shall have expertise in
7comprehensive sexual health education and HIV prevention
8education and have knowledge of the most recent medically
9accurate research on the relevant topic or topics covered in their
10instruction.

SEC. 13.  

Section 51937 of the Education Code is amended to
18read:

51937.  

It is the intent of the Legislature to encourage pupils
20to communicate with their parents or guardians about human
21sexuality and HIV and to respect the rights of parents or guardians
22to supervise their children’s education on these subjects. The
23Legislature intends to create a streamlined process to make it easier
24for parents and guardians to review materials and evaluation tools
25related to comprehensive sexual health education and HIV
26prevention education, and, if they wish, to excuse their children
27from participation in all or part of that instruction or evaluation.
28The Legislature recognizes that while parents and guardians
29overwhelmingly support medically accurate, comprehensive sex
30education, parents and guardians have the ultimate responsibility
31for imparting values regarding human sexuality to their children.

SEC. 14.  

Section 51938 of the Education Code is amended to
33read:

51938.  

(a) A parent or guardian of a pupil has the right to
35excuse their child from all or part of comprehensive sexual health
36education, HIV prevention education, and assessments related to
37that education through a passive consent (“opt-out”) process. A
38school district shall not require active parental consent (“opt-in”)
39for comprehensive sexual health education and HIV prevention
40education.

P10   1(b) At the beginning of each school year, or, for a pupil who
2enrolls in a school after the beginning of the school year, at the
3time of that pupil’s enrollment, each school district shall notify
4the parent or guardian of each pupil about instruction in
5comprehensive sexual health education and HIV prevention
6education and research on pupil health behaviors and risks planned
7for the coming year. The notice shall do all of the following:

8(1) Advise the parent or guardian that written and audiovisual
9educational materials used in comprehensive sexual health
10education and HIV prevention education are available for
11inspection.

12(2) Advise the parent or guardian whether the comprehensive
13sexual health education or HIV prevention education will be taught
14by school district personnel or by outside consultants. A school
15district may provide comprehensive sexual health education or
16HIV prevention education, to be taught by outside consultants,
17and may hold an assembly to deliver comprehensive sexual health
18education or HIV prevention education by guest speakers, but if
19it elects to provide comprehensive sexual health education or HIV
20prevention education in either of these manners, the notice shall
21include the date of the instruction, the name of the organization
22or affiliation of each guest speaker, and information stating the
23right of the parent or guardian to request a copy of this section,
24Section 51933, and Section 51934. If arrangements for this
25instruction are made after the beginning of the school year, notice
26shall be made by mail or another commonly used method of
27notification, no fewer than 14 days before the instruction is
28delivered.

29(3) Include information explaining the parent’s or guardian’s
30right to request a copy of this chapter.

31(4) Advise the parent or guardian that the parent or guardian
32has the right to excuse their child from comprehensive sexual
33health education and HIV prevention education and that in order
34to excuse their child they must state their request in writing to the
35school district.

36(c) Notwithstanding Section 51513, anonymous, voluntary, and
37confidential research and evaluation tools to measure pupils’ health
38behaviors and risks, including tests, questionnaires, and surveys
39containing age-appropriate questions about the pupil’s attitudes
40concerning or practices relating to sex, may be administered to
P11   1any pupil in grades 7 to 12, inclusive. A parent or guardian has
2the right to excuse their child from the test, questionnaire, or survey
3through a passive consent (“opt-out”) process. A school district
4shall not require active parental consent (“opt-in”) for these tests,
5questionnaires, or surveys in grades 7 to 12, inclusive. Parents or
6guardians shall be notified in writing that this test, questionnaire,
7or survey is to be administered, given the opportunity to review
8the test, questionnaire, or survey if they wish, notified of their right
9to excuse their child from the test, questionnaire, or survey, and
10informed that in order to excuse their child they must state their
11request in writing to the school district.

12(d) The use of outside consultants or guest speakers as described
13in paragraph (2) of subdivision (b) is within the discretion of the
14 school district.

SEC. 15.  

Section 51939 of the Education Code is amended to

(a) A pupil may not attend any class in comprehensive
29sexual health education or HIV prevention education, or participate
30in any anonymous, voluntary, and confidential test, questionnaire,
31or survey on pupil health behaviors and risks, if the school has
32received a written request from the pupil’s parent or guardian
33excusing the pupil from participation.

34(b) A pupil may not be subject to disciplinary action, academic
35 penalty, or other sanction if the pupil’s parent or guardian declines
36to permit the pupil to receive comprehensive sexual health
37education or HIV prevention education or to participate in
38anonymous, voluntary, and confidential tests, questionnaires, or
39surveys on pupil health behaviors and risks.

P14   1(c) While comprehensive sexual health education, HIV
2prevention education, or anonymous, voluntary, and confidential
3test, questionnaire, or survey on pupil health behaviors and risks
4is being administered, an alternative educational activity shall be
5made available to pupils whose parents or guardians have requested
6that they not receive the instruction or participate in the test,

Section 14.5 of this bill incorporates amendments to
9Section 51938 of the Education Code proposed by both this bill
10and Assembly Bill 517. It shall only become operative if (1) both
11bills are enacted and become effective on or before January 1,
122016, (2) each bill amends Section 51938 of the Education Code,
13and (3) this bill is enacted after Assembly Bill 517, in which case
14Section 14 of this bill shall not become operative.
