(1) Existing law appropriates $1,250,000,000, from the General Fund to the Superintendent of Public Instruction for transfer to Section A of the State School Fund to support the integration of academic content standards in instruction, as specified, and requires the Superintendent to apportion these funds to school districts, county offices of education, charter schools, and the state special schools using an equal rate per pupil based on prior year enrollment. Existing law, among other things, requires the school districts, county offices of education, charter schools, or state special schools receiving these funds to use them for certain purposes, including professional development of teachers, administrators, paraprofessional educators, or other classified employees involved in the direct instruction of pupils, as specified.

This bill would make these provisions inoperative on May 15, 2014, and repealed as of January 1, 2015, and would, except as provided in (2), require the Superintendent to apportion any of the appropriated moneys not already apportioned pursuant to the authority described above to school districts, county offices of education, and charter schools using an equal rate per unit of average daily attendance.

(2) This bill, on May 15, 2014, would, from the appropriated moneys not already apportioned pursuant to the authority described in (1), appropriate $50,000,000 to the Superintendent for purposes of establishing pilot programs in urban, suburban, and rural school districts that measure the effectiveness of the adopted common core academic content standards and adopted curriculum frameworks that are aligned to the adopted common core academic content standards. The bill would require a school district receiving funding to establish a pilot program, to develop, on or before July 1, 2015, and in consultation with parental organizations in the district, the pilot program. The bill would require the school district to review and revise, in consultation with parental organizations in the district, the pilot program every 6 months. The bill would require the school district to submit to the State Department of Education the pilot program and revisions of the pilot program for review. The bill would require the school district to make available to the public the pilot program and revisions to the pilot program.

(3) This bill would declare that it is to take effect immediately as an urgency statute.

Existing law provides that the members of the State Allocation Board and the Members of the Legislature meeting with the board receive no compensation for the services they provide under the Leroy F. Greene School Facilities Act of 1998, but are to be reimbursed for the actual and necessary expenses they incur in connection with the duties they perform pursuant to that act.

Sec. 85.  

(a) (1) The sum of one billion two hundred fifty
4million dollars ($1,250,000,000) is hereby appropriated from the
P3    1General Fund to the Superintendent of Public Instruction for
2transfer to Section A of the State School Fund. The sum of six
3hundred twenty-five million dollars ($625,000,000) shall be
4transferred in July 2013 and the sum of six hundred twenty-five
5million dollars ($625,000,000) shall be transferred in August 2013.

6(2) It is the intent of the Legislature that school districts, county
7offices of education, charter schools, and the state special schools
8use funds allocated pursuant to subdivision (b) to support the
9integration of academic content standards in instruction adopted
10pursuant to Sections 60605.8, 60605.85, 60605.10, 60605.11, and
1160811.3 of the Education Code, for kindergarten and grades 1 to
1212, inclusive, for purposes of establishing high-quality instructional
13programs for all pupils.

14(b) The Superintendent of Public Instruction shall apportion
15funds to school districts, county offices of education, charter
16schools, and the state special schools using an equal rate per pupil
17based on prior year enrollment.

18(c) A school district, county office of education, charter school,
19or state special school may encumber funds apportioned pursuant
20to this section at any time during the 2013-14 or 2014-15 fiscal
21year.

22(d) A school district, county office of education, charter school,
23or state special school shall expend funds allocated pursuant to
24this section for any of the following purposes:

25(1) Professional development for teachers, administrators, and
26paraprofessional educators or other classified employees involved
27in the direct instruction of pupils that is aligned to the academic
28content standards adopted pursuant to Sections 60605.8, 60605.11,
2960605.85, and 60811.3 of the Education Code.

30(2) Instructional materials aligned to the academic content
31standards adopted pursuant to Sections 60605.8, 60605.85,
3260605.11, and 60811.3 of the Education Code, including, but not
33limited to, supplemental instructional materials as provided in
34Sections 60605.86, 60605.87, and 60605.88 of the Education Code.

35(3) Integration of these academic content standards through
36technology-based instruction for purposes of improving the
37academic performance of pupils, including, but not necessarily
38limited to, expenditures necessary to support the administration
39of computer-based assessments and provide high-speed,
P4    1high-bandwidth Internet connectivity for the purpose of
2administration of computer-based assessments.

3(e) As a condition of receiving funds allocated pursuant to this
4section, a school district, county office of education, charter school,
5or state special school shall do both of the following:

6(1) Develop and adopt a plan delineating how funds allocated
7pursuant to this section shall be spent. The plan shall be explained
8in a public meeting of the governing board of the school district,
9county board of education, or governing body of the charter school,
10before its adoption in a subsequent public meeting.

11(2) On or before July 1, 2015, report detailed expenditure
12information to the State Department of Education, including, but
13not limited to, specific purchases made and the number of teachers,
14administrators, or paraprofessional educators that received
15professional development. The State Department of Education
16shall determine the format for this report.

17(f) The State Department of Education shall summarize the
18information reported pursuant to paragraph (2) of subdivision (e)
19and shall submit the summary to the appropriate budget
20subcommittees and policy committees of the Legislature and to
21the Department of Finance on or before January 1, 2016.

22(g) Funding apportioned pursuant to this section is specifically
23intended to fund, and shall first be used to offset, the costs of any
24new programs or higher levels of service associated with
25implementation of the academic content standards adopted by the
26State Board of Education pursuant to Sections 60605.8, 60605.85,
2760605.10, 60605.11, and 60811.3 of the Education Code, including
28those required by this section or Article 4.5 (commencing with
29Section 52060) of Chapter 6.1 of Part 28 of Division 4 of Title 2
30of the Education Code.

31(h) Funding apportioned pursuant to this section is subject to
32the annual audits required by Section 41020 of the Education Code.

33(i) For purposes of making the computations required by Section
348 of Article XVI of the California Constitution, of the funds
35appropriated by this section:

36(1) One billion dollars ($1,000,000,000) shall be deemed to be
37“General Fund revenues appropriated for school districts,” as
38defined in subdivision (c) of Section 41202 of the Education Code,
39for the 2012-13 fiscal year, and included within the “total
40allocations to school districts and community college districts from
P5    1General Fund proceeds of taxes appropriated pursuant to Article
2XIII B,” as defined in subdivision (e) of Section 41202 of the
3Education Code, for the 2012-13 fiscal year.

4(2) Two hundred fifty million dollars ($250,000,000) shall be
5deemed to be “General Fund revenues appropriated for school
6districts,” as defined in subdivision (c) of Section 41202 of the
7Education Code, for the 2013-14 fiscal year, and included within
8the “total allocations to school districts and community college
9districts from General Fund proceeds of taxes appropriated pursuant
10to Article XIII B,” as defined in subdivision (e) of Section 41202
11of the Education Code, for the 2013-14 fiscal year.

12(j)  This section shall become inoperative on May 15, 2014,
13and, as of January 1, 2015, is repealed, unless a later enacted
14statute, that becomes operative on or before January 1, 2015,
15deletes or extends the dates on which it becomes inoperative and
16is repealed.

Except as provided in Section 3 of this act, on May 15,
182014, or as soon thereafter as is feasible, any moneys appropriated,
19but not already apportioned by the Superintendent of Public

29appropriated to the Superintendent of Public Instruction for
30purposes of establishing pilot programs in urban, suburban, and
31rural school districts that measure the effectiveness of both of the

This act is an urgency statute necessary for the
8immediate preservation of the public peace, health, or safety within
9the meaning of Article IV of the Constitution and shall go into
10immediate effect. The facts constituting the necessity are:

12standards are effective before implementing them across the state,
13it is necessary that this act take effect immediately.

SECTION 1.  

Section 17070.30 of the Education Code is
15amended to read:

The State Allocation Board is continued in existence
17for the purpose of this chapter. The members of the board and the
18Members of the Legislature meeting with the board shall receive
19no compensation for the services they provide under this chapter,
20but shall be reimbursed for the actual and necessary expenses they
21incur in connection with the duties they perform pursuant to this
22chapter, to be paid as an administrative expense.
