Existing law makes it a crime for a person who, with the intent to place another person in reasonable fear for his or her safety, or the safety of the other person’s immediate family, by means of an electronic communication device, and without consent of the other person, and for the purpose of imminently causing that other person unwanted contact, injury, or harassment by a 3rd party, distributes specified identifying information that would be likely to incite or produce that unlawful action.

This bill would make it a misdemeanor for any person who, with the intent to cause substantial emotional distress or humiliation to another person, by means of an electronic communication device, and without consent of the other person, electronically distributes, publishes, emails, hyperlinks, or makes available for downloading nude images of the other person along with personal identifying information of the other person.

By creating a new crime, this bill would impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

9electronically distributes, publishes, e-mails, hyperlinks, or makes
10available for downloading, personal identifying information,
11including, but not limited to, a digital image of another person, or
12an electronic message of a harassing nature about another person,
13which would be likely to incite or produce that unlawful action,
14is guilty of a misdemeanor punishable by up to one year in a county
15jail, by a fine of not more than one thousand dollars ($1,000), or
16by both that fine and imprisonment.

17(2) Every person who, with the intent to cause substantial

5(b) For purposes of this section, “electronic communication
6device” includes, but is not limited to, telephones, cell phones,
7computers, Internet Web pages or sites, Internet phones, hybrid
8cellular/Internet/wireless devices, personal digital assistants
9(PDAs), video recorders, fax machines, or pagers. “Electronic
10communication” has the same meaning as the term is defined in
11Section 2510(12) of Title 18 of the United States Code.

12(c) For purposes of this section, the following terms apply:

13(1) “Harassment” means a knowing and willful course of
14conduct directed at a specific person that a reasonable person would
15consider as seriously alarming, seriously annoying, seriously
16tormenting, or seriously terrorizing the person and that serves no
17legitimate purpose.

18(2) “Of a harassing nature” means of a nature that a reasonable
19person would consider as seriously alarming, seriously annoying,
20seriously tormenting, or seriously terrorizing of the person and
21that serves no legitimate purpose.

No reimbursement is required by this act pursuant to
23Section 6 of Article XIII B of the California Constitution because
24the only costs that may be incurred by a local agency or school
25district will be incurred because this act creates a new crime or
26infraction, eliminates a crime or infraction, or changes the penalty
27for a crime or infraction, within the meaning of Section 17556 of
28the Government Code, or changes the definition of a crime within
29the meaning of Section 6 of Article XIII B of the California
30Constitution.

This act is an urgency statute necessary for the
32immediate preservation of the public peace, health, or safety within
33the meaning of Article IV of the Constitution and shall go into
34immediate effect. The facts constituting the necessity are:

35In order to protect the privacy of the public and the safety of the
36public at the earliest possible time, it is necessary for this act to
37take effect immediately.

SECTION 1.  

Section 78581 of the Food and Agricultural Code
39 is amended to read:

78581.  

(a) If the secretary finds that a favorable vote has been
2given, the secretary shall certify and give notice of the favorable
3vote to all receivers whose names and addresses are on file with
4the secretary.

5(b) If the secretary finds that a favorable vote has not been given,
6the secretary shall so certify and declare this chapter inoperative.
7The secretary shall also notify the appropriate policy committees
8in both the Assembly and Senate that the chapter is inoperative.
