SUMMARY : Places initiative on the statewide ballot to allow
budgetary flexibility related to the expenditure of Proposition
98 funding, as it pertains to After School programs.
The Senate amendments delete the Assembly version of this bill
and instead make the following changes, contingent upon approval
by the voters:
1)Repeal the "continuous appropriation" authority for the After
School Education and Safety (ASES) Program, thus allowing
appropriation decisions to be made annually in the Budget Act.
2)Remove the statutorily-established minimum appropriation level
($550 million) for the ASES Program.
3)Allow for ASES Program statutes to be amended, via the
legislative process, by a majority vote of the Legislature.
4)Require the Secretary of State to submit the above-noted
changes for approval by the voters at the November 2008
statewide election.
5)Retain the ASES programmatic structure, including the
statutorily established grant amounts, determination of
program eligibility, attendance requirements, and the like.
6)Contain an urgency clause to ensure eligibility for the
November 2008 statewide election.

7)Declare this bill take effect immediately as an urgency
statute.
AS PASSED BY THE ASSEMBLY , this bill expanded the types of
affordable housing for elderly or disabled persons that are
exempt from licensure by the Department of Social Services
(DSS), under the California Community Care Facilities Act.
FISCAL EFFECT : Consistent with 2008-09 Budget package.
