SUMMARY
This bill requires the Board of Barbering and Cosmetology to:
1)Adopt regulations by January 1, 2007 setting forth standards
and requirements for the use of pedicure equipment, including
procedures to ensure the proper and safe operation of pedicure
spa equipment.
2)Establish penalties, including remediation requirements, for
licensees and establishments that violate health and safety
regulations.
FISCAL EFFECT
1)Additional ongoing special fund costs of $400,000 for four new
positions for inspecting pedicure spa equipment and two
positions to track, schedule, and oversee the remediation
program, and unknown additional contract costs to provide the
remediation program. [Board of Barbering and Cosmetology Fund,
which is projected to have a balance of $3.1 million at the
end of 2004, 05.] These costs would be offset in part by fine
revenues of about $24,000.
2)Costs to adopt the required regulations are absorbable.
COMMENTS
1)Purpose . According to the sponsor, Amerispa, the recent
outbreak of bacterial infections at nail salons and pedicure
salons stems from operators not practicing proper procedures
and protocol for sanitizing and disinfecting nail salon

equipment. This bill requires the board to establish safety
standards for salons and pedicure foot spas.
2)Opposition . The Professional Beauty Federation of California
opposes the bill unless amended to limit the provision
relating to remediation for licensees and establishments that
violate the health and safety code. The PBFC believes this
subdivision is too broad and would force the board to require
remediation for all licensees regulated by the board, not just
those provided for under this section.
