SUMMARY
This bill requires state and local government agencies to
administer an employee time bank for peace officers.
Specifically, this bill:
1)Requires state and local government agencies, upon the request
of a recognized employee organization representing peace
officers, to administer an employee time bank for use by
members of the employee organization for the purposes of
carrying out the business of that employee organization.
2)Authorizes members of a recognized employee organization to
contribute sick leave time, vacation time, annual leave time,
or other hourly time to the employee time bank for use by
employee organization members for employee organization
business.
3)Provides that the employee time bank shall be in addition to
the release time without loss of compensation granted to
employee representatives when formally meeting and conferring
with the public agency on matters within the scope of
representation.
FISCAL EFFECT
The bill provides that costs associated with the administration
of the employee time bank are to be borne by the employee
organization.
COMMENTS
1)Background . The Meyers-Milias-Brown Act and the Ralph C.

Dills Act, which governs public agency employer-employee
relations and state employer-employee relations, respectively,
permit a public agency employee representative of a recognized
employee organization and a state employee representative of a
recognized employee organization reasonable time off without
loss of compensation or other benefits when formally meeting
and conferring with representatives of the public employer on
matters within the scope of representation.
2)Purpose . According to the sponsor, Peace Officers Research
Association of California, the time banks established pursuant
to this bill will allow peace officers to receive compensation
for duties performed while acting as a representative or
officer of a public employee organization that presently are
not eligible for compensation, such as legislative business.
3)DPA Concerns . The Department of Personnel Administration has
expressed the concern that the substance of this bill should
be subject to collective bargaining, notwithstanding the
requirement for employee organizations to bear the costs of
establishing time banks.
