   An act to amend Section  302   321.6  of
the Public Utilities Code, relating to public utilities.

   AB 2447, as amended, Diaz.  Public Utilities Commission  :
information practices  . 
   Under existing law, the Public Utilities Commission has regulatory
authority over public utilities and can establish its own
procedures, subject to statute and due process.  The existing Public
Utilities Act requires the commission to develop, publish, and
annually update an annual work plan access guide which describes in
clear detail the scheduled ratemaking proceedings and other decisions
that may be considered by the commission during the calendar year.
The act further requires the commission to develop a program to
disseminate the information in the guide utilizing computer mailing
lists to provide regular updates on the information to those members
of the public and organizations which request that information.
   This bill would additionally require the commission to post the
guide on the commission's Internet Web site.  The bill would require
the commission to annually publish on its Internet Web site, a
listing of the reports that the commission is required to file with
the Legislature with information relative to the status of each
report.  The bill would require that reports that are required to be
filed with the Legislature be made available to the public on the
commission's Internet Web site for at least 5 years from the date for
delivery of the report to the Legislature, except for one-time
reports, which would be required to be made available for at least 10
years from the date for delivery of the report to the Legislature.
 
   The Public Utilities Act requires each commissioner, before
entering upon the duties of the office, to take and subscribe the
constitutional oath of office.
   This bill would make a technical, nonsubstantive change to that
provision.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  
  SECTION 1.  Section 302 of the Public Utilities Code is 

  SECTION 1.  Section 321.6 of the Public Utilities Code is amended
to read: 
   321.6.   (a)  The commission shall develop, publish, and
annually update an annual work plan access guide which describes in
clear detail the scheduled ratemaking proceedings and other decisions
that may be considered by the commission during the calendar year.
The guide shall include information on how members of the public and
ratepayers can gain access to the commission's ratemaking process and
information regarding the specific matters to be decided.  It shall
also include information on the operation of the office of the public
advisor and identify the names and telephone numbers of those
contact persons responsible for specific cases and matters to be
decided.  The commission shall  post the information on the
commission's Internet Web site and  develop a program to
disseminate the information in the guide utilizing computer mailing
lists to provide regular updates on the information to those members
of the public and organizations which request that information.  The
annual work plan access guide shall be transmitted to the Legislature
between January 15 and February 1 of each year.  
   (b) The commission shall annually publish on its Internet Web site
a listing of the reports that the commission is required to file
with the Legislature with information relative to the status of each
report.  Every report that the commission is required to file with
the Legislature shall be made available to the public on the
commission's Internet Web site for at least five years from the date
for delivery of the report to the Legislature, except for one-time
reports, which shall be made available to the public on the
commission's Internet Web site for at least 10 years from the date
for delivery of the report to the Legislature.
