    An act to add Section 17357.5 to the Education Code,
relating to public schools.   An act to add Section 1229
to the Water Code, relating to water.

   AB 1647, as amended, Wiggins.   School building
construction: prefabricated materials   Appropriations
of water:  livestock stockponds  . 
   The Water Rights Permitting Reform Act of 1988 authorizes any
person to obtain a right to appropriate water for a small domestic or
livestock stockpond use, as defined, upon registering the use with
the State Water Resources Control Board, as prescribed, payment of a
registration fee, and application of the water to reasonable and
beneficial use with due diligence. The act authorizes any registrant
to change the point of diversion or place of use by delivering to the
board an amended registration form, including payment of the
registration fee, but prohibits a change in the purpose of the use.
   This bill would provide that, for the purposes of the act, the use
of a livestock stockpond for irrigation purposes does not constitute
a change in the purpose of the use of the water involved. 

   Existing law establishes various school construction health and
safety requirements, including, but not limited to, certain
requirements that the Department of General Services approve
construction plans for compliance with prescribed seismic safety and
fitness-for-use requirements.
   Existing law authorizes the department to adopt regulations for
safety and design of factory-built buildings for use as school
buildings, and to approve or reject plans and specifications
submitted by manufacturers of factory-built buildings.
   This bill would require the Department of General Services to
develop an inventory of prefabricated buildings and modular units in
use immediately preceding January 1, 2004, by school districts in San
Bernardino and Riverside Counties and a list of all new
prefabricated and modular buildings and units authorized commencing
January 1, 2004, through January 1, 2005, and to report to specified
committees of the Legislature by July 1, 2005.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  
  SECTION 1.  Section 17357.5 is added to the Education Code,
 
  SECTION 1.  Section 1229 is added to the Water Code, to read:
   1229.  For the purposes of this article, the use of a livestock
stockpond for irrigation purposes does not constitute a change in the
purpose of the use of the water involved.   to read:
   17357.5.  The Department of General Services shall develop an
inventory of prefabricated buildings and modular units in use January
1, 2004, by school districts in San Bernardino and Riverside
Counties, including, but not limited to, the length of service and
the occupancy levels of those buildings and units.  The Department of
General Services shall develop a written list of all new
prefabricated and modular buildings and units authorized commencing
January 1, 2004, through January 1, 2005.  The Department of General
Services shall report to the Senate Labor and Industrial Relations
Committee, the Senate Education Committee, the Assembly Labor and
Employment Committee, and the Assembly Education Committee by July 1,
2005.  The report shall include, but not be limited to, the
inventory and the list.
