SUMMARY : Authorizes various transactions between the City of
Newport Beach (City) and the County of Orange (County)
concerning public trust lands and authorizes the City to expend
certain tideland-related funds for the Upper Newport Beach
Ecological Reserve (Reserve).
The Senate amendments delete the Assembly version of this bill
and instead:
1)Declare that expenditures by the City from its Tideland
Capital Fund to acquire or improve real property in the
Reserve is in furtherance of trust purposes, irrespective of
the status of the real property as state tide and submerged
lands.
2)Authorize the City to make expenditures from its Tideland
Operation and Maintenance Fund and Upper Newport Bay
Restoration Fund for lands and facilities within the Reserve,
irrespective of their status as state tide and submerged
lands, if in furtherance of the public trust.
3)Authorize the City, with the concurrence of the State Lands
Commission (SLC), to convey to the County, subject to the
public trust, certain described lands.
4)Confirm that certain described lands, which are owned by the
County and dedicated by the County to the public trust, are to
be held in trust by the County pursuant to existing statutes
governing trust lands.
5)Authorize the County, with the concurrence of SLC, to convey
to the City, subject to the public trust, certain described
lands.

AS PASSED BY THE ASSEMBLY , this bill authorized the Public
Utilities Commission, as part of its rate-setting function, to
authorize, through the end of 2008, pricing incentives for heavy
industrial customers that agree to optional interruptable or
curtailable electrical service.
FISCAL EFFECT : Unknown
COMMENTS : This bill was completely amended in the Senate, and
the provisions of this bill as approved by the Assembly were
deleted.
